Terms of Service

By installing and using the Whatsify app on your Shopify store, you agree to be bound by the following Terms of Service. Please read them carefully.

1. Service Description

Whatsify is a Shopify application that automates customer communication via WhatsApp. By scanning our QR code, you authorize Whatsify to act as a "Linked Device" on your WhatsApp account to send automated notifications (such as order confirmations and abandoned cart reminders).

2. Connection & Usage Risks

Please acknowledge the following regarding the nature of our service:

  • Unofficial API: Whatsify utilizes a custom implementation to connect to WhatsApp (simulating a browser/device connection) rather than the official WhatsApp Business API. This allows us to offer affordable, unlimited messaging.
  • Account Safety: While we simulate human behavior (e.g., typing delays) to minimize risk, you acknowledge that using third-party automation tools carries a risk of your WhatsApp number being restricted or banned by WhatsApp.
  • "Warmed Up" Numbers: We strongly recommend using a WhatsApp number that has been active for at least 6 months. Using a brand new number to send high volumes of messages immediately increases the risk of a ban.
  • Liability Waiver: Whatsify is not responsible for any account bans, restrictions, or suspensions imposed by WhatsApp. You use this service at your own risk.

3. User Responsibilities

You agree to:

  • Maintain Connection: Keep your host device (phone) connected to the internet so the "Linked Device" session remains active.
  • Legal Compliance: Ensure your messages comply with all local laws and WhatsApp’s Commerce Policies. You are solely responsible for the content of the messages sent to your customers.
  • Anti-Spam: Do not use Whatsify to send unsolicited spam or harassment. We reserve the right to terminate accounts that abuse the platform.

4. Payments & Refunds

  • Subscription: Whatsify is billed via Shopify’s billing system. Charges will appear on your monthly Shopify invoice.
  • Cancellations: You may cancel your subscription at any time by uninstalling the app.
  • Refunds: Refunds are handled on a case-by-case basis and are generally not provided for partial months or unused services.

5. Limitation of Liability

To the maximum extent permitted by law, Whatsify and its developers shall not be liable for any indirect, incidental, or consequential damages resulting from:

  • Your use or inability to use the service.
  • Messaging failures, delays, or undelivered notifications.
  • Loss of data or business interruptions (including WhatsApp account bans).

6. Termination

We reserve the right to suspend or terminate your access to Whatsify immediately, without prior notice, if you violate these Terms, specifically regarding spam or abuse of the WhatsApp network.

7. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes your acceptance of the new Terms.
